Difference from EU-Internal Regulation

In the EU, there is an automatic permanent residence right after 5 years -- regardless of employment. Switzerland negotiated a more restrictive solution:

  • Permanent residence right only for economically active persons and families
  • Social welfare dependency extends the waiting period
  • No automatic right for economically inactive persons

EFTA Nationals

The regulations apply equally to nationals of EFTA member states:

  • Iceland, Liechtenstein and Norway are integrated via the EFTA Convention
  • Same rights and obligations as under the FMPA
  • Coordination via the EFTA supervisory mechanism

Cantonal Competences

The cantons retain important enforcement competences:

  • Granting and renewal of residence permits
  • Labour market testing (where applicable)
  • Implementation of integration measures
  • Reporting of regional particularities for monitoring
  • Implementation of cantonal protection measures upon activation of the clause
